E2 Visa Case Study 1

Steven Lawson

Marie, a French citizen, and Jamie, a French and Canadian citizen, purchase a bakery in San Francisco. Once the business is ready to open, they each apply for E2 visas in Toronto. Marie and Jamie each own 50% of the business and they plan to hire both French and Canadian citizens to work at their bakery. They and their business meet all requirements for an E2 visa, and their applications are approved. Since Jamie is both a French and Canadian citizen, he can only select one nationality for his E2 visa to be issued. Additionally, since each own exactly 50% of the business, both French and Canadian citizens are permitted to apply for E2 visas as Essential Employees provided Jamie has his E2 visa issued as a Canadian citizen.
